The Polk County Sheriffs Office has received a generous donation in the amount of $25,456.00
from the Alabama Coushatta Tribal Council to support the purchase of an automated citation
management system, including ticket writers and the associated operating software.
The Sheriffs Office proposes to allocate $10,000.00 from asset forfeiture funds toward the
purchase of ten (10) ticket writer software packages with printers. The remaining costs will be
supported through existing and future funding.
The system carries an ongoing annual cost of $15,345.00, which can be incorporated into the
Sheriffs Office operating budget in future fiscal years.
This technology will improve efficiency, accuracy, and record management for citation
processing and will enhance overall operational effectiveness.

The Sheriff is requesting this item be placed on the Commissioner's Court agenda for February 10th. The
Sheriff's Office has worked with the Maintenance Department to obtain a quote for the construction of an
office within the CID area of the Sheriffs Office to support evidence processing. This project will create
additional office space for future personnel expansion and include the installation of a glass entry door to
the CID Division, allowing the area to be secured during case briefings.
Currently, two state employees are assigned to the Sheriffs Office, with a third expected to join soon. These
state employees are a valuable asset in combating crime in Polk County, as they provide access to analytical
resources and equipment not otherwise available to the Sheriffs Office.
A quote has been received from DP FCI Construction in the amount of $21,798.77. An initial upfront
payment of$10,899.39 for materials will be issued to the contractor with $10,899.38 remaining to be paid
upon completion. This expense will be paid from the Sheriffs Office asset forfeiture line item and will
result in no cost to taxpayers. In addition to supporting future growth, this project will enhance privacy and
security within the CID Division for preparation on major cases.

Dear Judge Murphy,
TAC Risk Management Pool (“TAC RMP”) through our strategic partnership with our
reinsurance cyber carrier, AIG and with TechGuard Security, a leading cybersecurity solutions
company, is proud to offer and provide a simulated phishing email and training platform we
call S.H.I.E.L.D. This new and exclusive resource of the TAC RMP cyber risk management
program is made available to members with cyber coverage. As you know, Texas counties face
mounting and ever-changing cyber threats and we are proud to extend this resource to your
county as a value add at no additional cost.
Texas counties are a prime target for cyber threat actors because of the types and volume of data
you possess in your county. We are seeing an upward trend in the number of attacks on county
networks to target your data, within the members of TAC RMP and throughout the state. Cyber
risk is a dynamic and fluid environment with threat actors adapting their tactics constantly.
Counties are challenged by limited budgets and resource constraints that are often exploited by
threat actors to gain access to your network but none more so than social engineering via
phishing.
Human Involvement in Cyber Attacks (Huntress and Infosecinstitute)
Key Statistics
• Phishing as a Primary Attack Vector: Over 90% of cyberattacks begin with phishing,
making it the leading method for breaching networks and stealing data.
• Email Initiation: Approximately 75% of cyberattacks start with a deceptive email, which
can include malware, credential theft, or impersonation scams.
• Human Error Contribution: Human error is responsible for 74% of data breaches, with
many incidents initiated by clicking on phishing links.
S.H.I.E.L.D. is intended to provide counties with a foundational resource to combat the most
prolific of cyber threats – business email compromise, while at the same time empowering and
creating human firewalls through engaging training. If you are familiar or currently use a

similar tool through vendors like KnowBe4, Huntress, or Arctic Wolf, S.H.I.E.L.D. will feel very
known to you, as the experience is similar.
If your county chooses to enroll, participate, and utilize this tool consistently, TAC RMP knows
it will help improve your county’s cyber resilience. In addition, your participation and
utilization of this tool will have the added benefit of potentially satisfying one of the required
TAC RMP cyber underwriting items contained in your renewal application – simulated phishing
email training.
Here is what you can expect during the enrollment and onboarding process:
• A kick-off meeting will be held with the county, TechGuard, and TAC RMP cyber team
to outline the tool, requirements, and detailed steps to enroll.
• The county and its chosen S.H.I.E.L.D. program administrator will have support
throughout the use of the tool from TechGuard for any technical matters.
• Once enrolled and setup is finalized, the county will have full control over the program
tool and its administration of the simulated phishing email campaigns you choose to run.
• Please refer to the enclosed Getting Starting and Onboarding Guide documents for more
details on this process.
Any user, emails, reports, or other sensitive information is individualized to only the county and
its designated program administrator(s). Other local governmental entities will not have access
to your data or reports.
TAC RMP is providing this service for the benefit of the county, which takes part in the
S.H.I.E.L.D. program at its own discretion, diligence, and risk. TAC RMP makes no warranties,
express or implied, in connection with the S.H.I.E.L.D. program tool, nor shall TAC RMP be held
liable for any costs or damages related to S.H.I.E.L.D. or any information provided from it.
Information from the assessment will be provided to TAC RMP but this information will not

A RESOLUTION AUTHORIZING PARTICIPATION IN THE U.S. IMMIGRATION AND
CUSTOMS ENFORCEMENT (ICE) 287(g) WARRANT SERVICE OFFICER PROGRAM
WHEREAS, Section 287(g) ofthe Immigration and Nationality Act authorizes the
U.S. Department of Homeland Security to enter into agreements with state and local law
enforcement agencies to perform certain immigration enforcement functions under federal
supervision; and
WHEREAS, the Warrant Service Officer (WSO) Model of the 287(g) program
allows designated local law enforcement officers to execute administrative warrants issued
by U.S. Immigration and Customs Enforcement (ICE) for individuals with pending
immigration enforcement actions; and
WHEREAS, the Polk County Commissioner's Court finds that participation in the
287(g) WSO Model will enhance cooperation with federal partners, support public safety,
and ensure the County's continued commitment to lawful and professional law
enforcement practices; and
WHEREAS, participation in this program will be limited to the scope of
authority provided under each model, and County personnel will remain under the
supervision of the PolkCounty Sheriffs Officeat all times.
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSIONERS COURT
OF POLK COUNTY, TEXAS, as follows:
Section 1. The Polk County Commissioner's Court hereby authorizes participation

WHEREAS, Texas Counties are the functional arm ofstate government and are responsible for the
operationand maintenance of local transportationinfrastructure, maintaining morethan halfofall
publicroad milesintheStateofTexasandensuringsafeandefficienttravelforresidents, businesses,
and emergency services; and
WHEREAS, the State Motor Fuels Tax, established in 1923 and last adjusted to twenty cents per
gallon in 1991, currently generates approximately $3.85 billion annually, of which one-fourth is
dedicated tothe Available School Fundandthe remaining three-fourths tothe State Highway Fund,
withonlyasmallportion - $7.3million- allocated totheCountyand Road DistrictHighway Fund
(also known as the Lateral Road Fund); and
WHEREAS, this allocation to Texas counties has remained unchanged since 1954despite decades
of population growth, inflation, and increasing transportation demands that have significantly
reduced the purchasing power ofcounties to maintain essential local infrastructure; and
WHEREAS, the proposed legislationwouldallocate one penny (one-twentieth, or 5%)ofthe State
Motor FuelsTax totheCountyand Road DistrictHighwayFundto bedistributed usingthe existing
statutoryformula; and
WHEREAS, the State ofTexas has also established additional registration fees forelectric vehicles
- $400 at initial registration and $200 annually thereafter - to offset the reduced motor fuels tax
revenues associated with non-fuel consuming vehicles; and
WHEREAS, while the fees are currently directed entirely to the State Highway Fund, counties
receive no portion ofthis new revenue source, despite being equally responsible for maintaining and
improving the localroadways on which these vehicles travel; and
WHEREAS,acompanion legislative proposal woulddedicate5%(one-twentieth)ofelectric vehicle
registration fee revenue to the County and Road District Highway Fund, thereby ensuring that
counties shareequitably inthe revenue derived from all classes ofvehicles using county roadways;
and
WHEREAS, increasing allocations from both the motor fuels tax and electric vehicle registration
fees would provide a sustainable, pay-as-you-go funding mechanism for county transportation
infrastructure without increasing tax rates or imposing new burdens on taxpayers, ensuring a fairer,
more efficient partnership between state and county governments in maintaining the Texas
transportation network.

WHEREAS, Texas Counties arethe functional arm ofstate government and are responsible for the
operation and management ofnumerous state programs as required or authorized by state law; and
WHEREAS, Texas Counties provide essentialstate services to constituents at the local level, many
ofwhich are fully or partially supported with funds disbursed by the State ofTexas throughthe state
appropriations process; and
WHEREAS, Texas Counties are required by state law to provide for the continuing education and
professional development of county officials and employees, often requiring travel and overnight
stays that are subject to the State ofTexas Hotel Occupancy Tax; and
WHEREAS, the State ofTexas currently exempts from the Hotel Occupancy Tax several entities,
including federal agencies, state government officials and employees, and certain charitable,
educational, and religious organizations, but does not exempt county governments, their officials, or
employees; and
WHEREAS, when counties, as political subdivisions ofthe State, pay the State Hotel Occupancy
Tax from revenues generated through localproperty taxes, it results inan inefficient practice known
as "tax churn," in which one taxing entity collects taxes from another taxing entity, ultimately
increasing the financial burden on local property taxpayers; and
WHEREAS, exempting Texas Counties from the State Hotel Occupancy Tax would reduce this
inefficiency, improve governmental accountability, and help alleviate the impact of rising local
property taxes on Texas citizens; and
WHEREAS, the exemption would further align counties with other government and nonprofit
entities alreadyrecognized understatelawasexempt fi*om thistax,ensuring consistentandequitable
tax treatment across all public entities.
NOW,THEREFORE, BE IT RESOLVED that the County CommissionersCourt does herebyfind
that it is in the best interest ofTexas counties and their taxpayers to support and favor the passageof
legislationthat exempts counties, their officials, and employees from payingthe State ofTexas Hotel
OccupancyTax whentraveling on official county business.
BE IT FURTHER RESOLVED that a copy ofthis resolution be forwarded to the members ofthe
