THEREFORE, BE IT RESOLVED, that after review, the Fulton County Commissioners hereby

Ohio that it is found and determined that all formal actions of this Board of County Commissioners, County

The Board of County Commissioners of Fulton County, Ohio met in regular session pursuant to notice, on
February 5, 2026, at 152 South Fulton Street, Wauseon, Ohio, with the following members present:

WHEREAS, it is necessary to publicly advertise to solicit competitive bids for Bridge G24.6
Rehabilitation; and

necessary right of way is available and agree to maintain the project and will make ample provisions each
year for maintenance and repair under authority of ORC 5535.01 and 5555.02; and
THEREFORE BE IT RESOLVED, that the Fulton County Board of Commissioners hereby approve
the Legal Notice as attached hereto and further authorize advertisement of the same; and

For Utility Scale Power Projects Per SB 52: Wind & ) February 5, 2026

The Board of County Commissioners of Fulton County, Ohio met in session pursuant to notice, on
February 5, 2026, at 152 South Fulton Street, Wauseon, Ohio, with all members present:

Commissioner ______________________________ moved for the adoption of the following resolution:
WHEREAS, Senate Bill 52 establishes new procedures to increase local oversight and control of site selection
for utility-scale wind and solar electric generation facilities before and during the Ohio Power Siting Board
review process; and
WHEREAS, Senate Bill 52 allows a Board of County Commissioners to prohibit the construction of utility-
scale wind or solar facilities altogether, or to prohibit their construction in certain designated zones in the
unincorporated area of the county; and
WHEREAS, applicants interested in constructing a solar or wind facility within the restricted area will submit
a request to the Board of County Commissioners to remove the proposed site from the excluded area; the Board
of Commissioners will require the developer to submit an application and required documents to the Fulton
County Regional Planning Commission(RPC) for review; upon review, the RPC will submit a recommendation
to the Board of County Commissioners for further consideration; and
WHEREAS, if a Board of Township Trustees intends to remove a restricted area, they will submit a request to
the Board of Commissioners to remove the proposed site from the excluded area; the Board of Commissioner
will require the Township to submit an application and supporting documents to the RPC for review; upon
review, the RPC will submit a recommendation to the Board of County Commissioners for further consideration;
and
NOW, THEREFORE BE IT RESOLVED, that the Board of County Commissioners, Fulton County, Ohio,
declares all unincorporated areas of Fulton county as restricted for utility scale power projects per Senate Bill
52 ;
BE IT FURTHER RESOLVED that it is found and determined that all formal actions of this Board of County
Commissioners, County of Fulton, State of Ohio concerning the adoption of this resolution were adopted in an
open meeting of this Board of County Commissioners, and that all deliberations of this Board of County
