Chairman Khoury called the meeting to order at 6:00 PM. Chairman Khoury explained the meeting process to the
attending public. Chairman Khoury presented minutes from two previous hearings for approval. The minutes
were approved by voice vote. Chairman Khoury called Village Case No. 26-ZPA-01-001.
Director Simmons presented an overview of the proposed project and the history of the property. The Petitioner,
Cary Apothecary, is proposing to relocate their existing retail business to the property located at 20 N First Street.
The business is seeking to occupy a vacant retail space within this building which also contains Cambridge
Exteriors. As proposed the business will provide retail, mental health services, and massage therapy. Per the
Village’s Unified Development Ordinance, massage establishments require conditional use approval within the
Village’s B-3 zoning district. Director Simmons provided an overview of the proposed business operation and
the applicability of the zoning and licensing requirements for massage establishments within the Village’s
Municipal Code.
Member Williams inquired about the location of the nearest massage establishments. Director Simmons
confirmed the two nearest establishments will be relocating as their existing building will be converted into
apartments. Director Simmons confirmed the subject property complied with the minimum separation of 1,000
feet from a preexisting massage establishment.
Chairman Khoury inquired if the Village received any comments from the public regarding the notice distributed
for the hearing. Director Simmons confirmed he spoke with one resident that had general concerns with parking
but did not object to the proposed use.

The Petitioner, Tami-Moore Kedzie, provided an overview of her proposed business and the history behind her
company. The business expansion is intended to add additional wellness services to her existing retail business.
Chairman Khoury asked if the petitioner had received any feedback from the notices distributed for the hearing.
The Petitioner indicated she did not receive any feedback on the proposal.
Chairman Khoury opened the discussion to the floor and invited comments from the public. Hearing none the
public comment portion was closed.
Chairman Khoury entertained a motion.
Member Graziano moved, seconded by Member Williams, to recommend to the Village Board of Trustees,
approval of a conditional use for a massage establishment for the property located at 20 N First Street, subject
to the following conditions:
1. The conditional use for a massage establishment shall be issued to the Cary Apothecary for the
property located at 20 N First Street.
2. The proposed improvements shall substantially conform to the attached plans and exhibits as part of
this petition, except as they may be changed to conform to Village Codes and all conditions of approval.
3. The use shall conform to the requirements of Section 14.3.12 of the Unified Development Ordinance
as they pertain to a massage establishment.
4. Any signs installed on the property for the business shall comply with the applicable requirements of
the Unified Development Ordinance.

REQUESTED ACTION: 1. Conditional Use for an Electronic Message Center Monument Sign
BACKGROUND
The Petitioner, Advia Credit Union, is seeking to install a new Electronic Message Center (EMC) sign on the property
located at 650 Northwest Highway. The new EMC sign will replace the existing monument sign located on the
property. Per the Village Unified Development Ordinance, EMC signs require conditional use approval. The ZPA
hearing was properly noticed in the February 24, 2026, edition of the Northwest Herald newspaper. In addition, the
Petitioner has completed the required written notice to property owners within 250 feet and staff posted a public
hearing sign on the Subject Property.
STAFF ANALYSIS
The subject property is located on Northwest Highway as an outlot of the Cary Square Shopping Center. The
property is zoned B-2 and is bordered by the B-2 district on the east, north, and west sides, and the M district to the
south across the railroad tracks. The property received conditional use approval for a drive-through restaurant in
1985 for a Kentucky Fried Chicken that operated on the property for several years. In 2017 the Village Board
approved a conditional use for a bank with drive-through for the Golden Eagle Community Bank. In 2018 the Village
approved a conditional use for an electronic message center monument sign for the existing bank. Following this
approval the Golden Eagle Community Bank was purchased and converted to the Advia Credit Union. The exiting
electronic message center sign was removed as part of this transition.

Per code the subject property is permitted one monument sign along its frontage of Route 14. The petitioner is
seeking to replace its existing monument sign with a new electronic message center sign. The new sign will measure
10 feet in height by 7.25 feet in width, or 72 square feet. The EMC portion of the sign will measure 24.8 square feet
or 34.4 percent of the total sign area. Per code electronic message center signs require conditional use approval and
must conform to various conditions including but not limited to:
1) Area devoted to EMC cannot exceed forty (40) percent of maximum allowed sign area.
2) Messages shall contain a static message only and not have movement, or the appearance of movement,
during the static display period.
3) Transition change from one message to another shall be instant and not dissolve, fade, scroll, travel, or
have similar transitions.
4) The message shall not change more frequently than once every three (3) seconds.
5) The EMC shall be equipped with a sensor or other device that automatically dims the sign according to
light conditions and comply with maximum illumination requirements.
Per the plans submitted, the proposed monument sign with EMC panel will comply with the above standards.
COMPREHENSIVE PLAN DESIGNATION
The subject property is designated as Commercial within the Village’s Comprehensive Plan. This designation is
appropriate for land uses such as retail shopping centers, restaurants, and office uses. The existing bank building
with a drive-through is consistent with this designation.
AUTHORITY AND JURISDICTION
Conditional Use
Acting in a quasi-judicial capacity, the Board has the duty to investigate the facts and draw a conclusion on the
request and recommend approval where the applicant has demonstrated by the preponderance of the evidence that
the standards set out below have been met. The Board shall recommend the permit be denied where the applicant
has failed to meet that burden. The petitioner must prove the following standards:
A. That the use will not be detrimental to or endanger the public health, safety, morals, comfort, or general
welfare;
B. That the use will not substantially diminish or impair the value of properties within the neighborhood, or
be injurious to the use and enjoyment of other property in the immediate vicinity;
C. That the use will not impede the normal and orderly development and improvement of surrounding property
for uses permitted in the district;
D. That the use will not substantially contribute to an overburdening of Municipal services; that adequate
utilities, access roads, drainage and other necessary facilities have been or are being provided; and that
adequate measures have been or will be taken to provide ingress and egress so as to minimize traffic
congestion in the public streets;
E. That the use will be consistent with the policies and future land use map(s) in the Village's comprehensive
plan;
F. That the use will comply with all other requirements of the Unified Development Ordinance, including, but
not limited to, the dimensional requirements of Chapter 2 and the supplemental use regulations in Chapters
3 and 4.
As part of the application submittal, the petitioner has provided a response to the conditional use standards. Per
Chapter 9 of the Unified Development Ordinance, the proposed conditional use permit for the electronic message

center sign shall be reviewed by the ZPA but final determination on the application shall be made by the Village
Board (VB FINAL).
RECOMMENDATION
In ZPA Case File No. 26-ZPA-02-003 it is recommended that the Board of Zoning, Planning and Appeals approve
a conditional use for an electronic message center sign for the property located at 650 Northwest Highway, subject
to the following conditions:
1. The electronic message center sign, including the location and size of the sign, shall substantially conform to the
plans and exhibits as submitted as part of this petition except as they may be revised to conform to Village code
requirements and all conditions of approval.
2. The electronic message center sign shall be equipped with an automatic dimming mechanism which
automatically adjusts the sign’s brightness in direct correlation with natural ambient light conditions.
3. Illumination of the electronic message center sign shall not exceed 0.3 foot-candles over the ambient lighting
conditions when measured at a distance equal to the square footage of the sign area.
4. The electronic message center shall not display any videos or any blinking, flashing, or scrolling script across
the viewing area. Any messages which are displayed shall be static in nature.
5. Any messages which are displayed shall not change more frequently than once every three (3) seconds.
6. The electronic message center portion of the monument sign shall not exceed forty percent of the total sign area.
MOTION
The Chairman will entertain a motion to approve a conditional use for an electronic message center sign for the
property located at 650 Northwest Highway, subject to the conditions listed in the staff report.
