LEGISLATION: ORD. NO. 16-2026 - An emergency ordinance amending Section 866.02(c) of the City of

for applicants for mobile food service operation permits shall be valid for a period of one (1)

BACKGROUND: Section 866.02(c) of the Codified Ordinances of the City of Brunswick requires that a B.C.I. and
F.B.I. Webcheck must be completed through the Medina County Sheriff’s Office and provided
with the original application for the owner/operator, the results of which shall be valid for a
period of one (1) year from the date of issuance.
PURPOSE AND The proposed legislation will allow the Mobile Food Service Operator's required BCI/FBI
EXPLANATION: webcheck to be valid for one year from the date of issuance, instead of one calendar year
(January 1 through December 31).

That this Ordinance is hereby declared to be an emergency measure necessary for the
immediate preservation of the public peace, property, health, safety or welfare, and for
the additional reason that immediate passage is necessary to provide for such updates to
the license requirements for mobile food service operators ahead of the 2026 season.

AN EMERGENCY ORDINANCE AMENDING SECTION 866.02(c) OF THE
CITY OF BRUNSWICK CODIFIED ORDINANCES TO PROVIDE THAT THE
RESULTS OF THE REQUIRED BCI/FBI WEBCHECKS FOR APPLICANTS
FOR MOBILE FOOD SERVICE OPERATION PERMITS SHALL BE VALID
FOR A PERIOD OF ONE (1) YEAR FROM THE DATE OF ISSUANCE.
WHEREAS: THE COUNCIL OF THE CITY OF BRUNSWICK HEREBY ORDAINS:
SECTION 1: That Section 866.02(c) of the Codified Ordinances is hereby amended to read as
follows:
“(c) A B.C.I. and F.B.I. Webcheck must be completed through the Medina
County Sheriff’s Office and provided with the original application for the
owner/operator, the results of which shall be valid for a period of one (1) year from
the date of issuance.”
SECTION 2: That this Ordinance is hereby declared to be an emergency measure necessary for
the immediate preservation of the public peace, property, health, safety or welfare,
and for the additional reason that immediate passage is necessary to provide for
such updates to the license requirements for mobile food service operators ahead
of the 2026 season. Therefore, the same shall be in full force and effect from
and after its passage by the required number of votes or from the earliest time
allowed by law.
