Call to Order The meeting was called to order by Mayor Kownick at 6:03 p.m. II. Roll Call The roll was called and all were present. III. Pledge of Allegiance Mayor Kownick led in the recitation of the Pledge of Allegiance. IV. Public Comments There being no comments, Mayor Kownick closed Public Comments 6:04 p.m. V. Discussion Items A. Discussion Regarding Video Gaming Regulations Director Simmons provided background on current video gaming regulations and potential ordinance changes. Trustee Walrath asked if current businesses not in compliance with the proposed changes to the Village's video gaming ordinance would be grandfathered or given time to come into compliance. Director Simmons stated the proposed changes would allow current businesses with video gaming licenses to be grandfathered unless the Board would like to proceed differently. Trustee Prusina supports the proposed update specifying that a change in 1 [PAGE 2] ownership would require the owners to apply for a new video gaming license and comply with the updated video gaming regulations. Trustee Collier asked if the Village could require businesses not in compliance with the proposed changes to the Village's video gaming regulations to become complaint by a specified date. Attorney Uhler stated the Village could require businesses to come into compliance to maintain their current video gaming license. Director Simmons stated language could be added to specify that a video gaming license could not be transferred due to a change in business ownership and would require the new owners to apply for a license. Trustee McAlpine stated it is important to balance appropriate regulations while continuing to be business-friendly. Trustee Walrath stated it is not appropriate to allow video gaming signage visible from the exterior of a business since video gaming is intended to be an ancillary feature to the main establishment. Director Simmons stated the Village can regulate the type of signage allowed for businesses with specific license types. Trustee Prusina stated he did not think there should be a cap on video gaming revenue as this could negatively affect successful businesses that are in compliance with Village code. Trustee Prusina stated he prefers giving non- compliant business incentives to become compliant or wait until the ownership changes rather than enacting regulations that would negatively affect the establishment. Trustee Prusina supports the proposed signage regulations prohibiting advertisement of video gaming that is visible from outside the establishment. Trustee Dudek does not agree with video gaming in general; however, he supports the current ratio of gaming terminals to seats as well as the proposed changes to signage and establishment layout regulations. Trustee Dudek is concerned that establishments whose video gaming revenue comprises approximately half of their overall revenue could be considered gaming cafes. Director Simmons stated Cary's zoning districts have different regulations regarding the types of establishments, such as bars and restaurants, that are allowed within those sections of the Village. Trustee Walrath suggested examining establishments' gaming revenue relative to overall revenue to determine their classification as either a bar or restaurant. Trustee Walrath stated the Village could consider different gaming regulations based on how the establishment is classified. It was the consensus of the Committee of the Whole to bring forward to a future Village Board meeting the proposed changes to signage and 2
