West Fargo City Commission Meeting

Commission Chambers 5:30 PM
The West Fargo City Commission met on Monday, March 1, 2021, at 5:30 pm. Those
present were Commissioners Bernie Dardis, Eric Gjerdevig, Brad Olson, and Mandy
George. Commissioner Mark Simmons was absent. President of the Board Bernie Dardis
called the meeting to order at 5:30 PM.
The Pledge of Allegiance was recited.
Commissioner Gjerdevig moved and Commissioner Olson seconded to approve the
order of the agenda as distributed. No opposition. Motion carried.
Commissioner Olson moved and Commissioner George seconded to approve the
minutes of February 16,2021 as presented. No opposition. Motion carried.
The Commission reviewed the Building Department Activity Report dated March 1, 2021
and Building Permits #210104-210159. Commissioner George moved and Commissioner
Olson seconded to approve the Building Permits as presented. No opposition. Motion
carried.
Commissioner Olson moved and Commissioner Gjerdevig seconded to approve the
following items from the Consent Agenda:
a. Bills
b. Games of Chance for Solid Brotherhood Mc RRV. Games to be conducted:
Raffle from 3-1-2021 to 4-2-2021 at Hooligans at 509 32nd Ave W
c. Games of Chance for West Fargo Exchange Club. Games to be conducted:
Raffle from March 1to June 10, 2021 at Bar Nine at 1405 Prairie Parkway
d. Games of Chance for West Fargo Lions Club. Games to be conducted: Raffle
from 3-26-2021 to 9-26-2021 at the Silver Dollar Bar at 221 Sheyenne st
e. Games of Chance for Red River Regional Marksmanship Center. Games to be
conducted: Raffle on 4-16-2021 and 4-17-2021 at the Red River Regional
Marksmanship Center at 640 16th st NE
f. Games of Chance for Pink It Forward. Games to be conducted: Raffle on 3-17­
2021 at the DoubleTree by Hilton at 825 E Beaton Dr
g. Release and Termination of Right to Reverter
No opposition. Motion carried.
Malachi Peterson, City Planner appeared before the Commission to hold the public
hearing and 1st Reading on the Rezoning at 5:30 pm on March 1, 2021 - Westview 5th
Addition Rezoning from R-1 SM: Mixed One & Two Family Dwelling to PUD: Planned Unit
Development. Members of the public came forth to speak on the item: Dale Knutson of
631 Westview Lane East in West Fargo, Brendan Muldoon on behalf of Mark Bucholz,
Riley Rude of Moorhead, Myra Kosak of 3760 7th Street East, Following discussion,
Commissioner George moved and Commissioner Olson seconded to approve the first
reading of the Westview 5th Addition Rezoning from R-1 SM: Mixed One & Two Family
Dwelling to PUD: Planned Unit Development. No opposition. Motion carried.

Tim Solberg, Planning and Zoning Director appeared before the Commission to hold
Public Hearing and 1st Reading on the Zoning Ordinance Text Amendment at 5:30 pm
on March 1,2021 for Zoning Ordinance Amendment to the A: Agricultural District
standards. Following discussion, Commissioner Olson moved and Commissioner
Gjerdevig seconded to approve the 1st Reading on the Zoning Ordinance Text
Amendment at 5:30 pm on March 1,2021 for Zoning Ordinance Amendment to the A:
Agricultural District standards. No opposition. Motion carried.
Tim Solberg, Planning and Zoning Director appeared before the Commission to review
the conditional use permit for off-premise signage at 2920 Sheyenne st. Jim Bullis came
forth to discuss the item. Following discussion, Commissioner George moved to approve
the conditional use permit for the off-premise signage. The motion failed on lack of a
second. Commissioner Olson moved and Commissioner Gjerdevig seconded to deny
the conditional use permit based on the recommendations of staff. Commissioner
George opposed. Motion carried on a 3:1 vote.
Nick Lee, City Administrator appeared before the Commission to ask for approval of
AGENDA ITEM FROM PRIOR COMMISSION MEETING on 2-16-2021: Approval of a Five
Year Remodel Exemption - All Season Motorsports has added an addition, which has
added over $45,000 in property value. Since they have met the application criteria and
the minimum value threshold they are eligible for this 5 year exemption. [2021,2022,
2023,2024,2025) and AGENDA ITEM FROM PRIOR COMMISSION MEETING on 2-16-2021:
Approval of a Five Year Remodel Exemption - Northern Stone has remodeled their
office, which has added over $45,000 in property value. Since they have met the
application criteria and the minimum value threshold they are eligible for this 5 year
exemption [2021,2022,2023,2024,2025). These two items were taken as a single
motion. Commissioner Gjerdevig moved and Commissioner George seconded to
approve the two exemptions. No opposition motion carried.
Dustin Scott, City Engineer appeared before the Commission to ask for approval of the
amended Engineer's Report and direct the Engineer to prepare plans and
specifications for Project No. 1316 Phase 2 - "Northside Sanitary Sewer Collector
Rehabilitation". Following discussion, Commissioner Gjerdevig moved and
Commissioner Olson seconded to approve the amended Engineer's Report and direct
the Engineer to prepare plans and specifications for Project No. 1316 Phase 2 ­
"Northside Sanitary Sewer Collector Rehabilitation". No opposisiton. Motion carried.
Dustin Scott, City Engineer appeared before the Commissioners to ask for approval of
the Engineer's Report and direct engineer to prepare plans and specifications for
Project No. 2260 - "Concrete Pavement Repair". Following discussion, Commissioner
Gjerdevig moved and Commissioner George seconded to approve Engineer's Report
and direct engineer to prepare plans and specifications for Project No. 2260 ­
"Concrete Pavement Repair". No opposition. Motion carried.

Dustin Scott, City Engineer appeared before the Commissioners to ask for approval of
the Task Order No. 35-2 for Sidewalk Improvement District No. 6056. Following discussion,
Commissioner Olson moved and Commissioner George seconded to approve the Task
Order No. 35-2 for Sidewalk Improvement District No. 6056. No opposition. Motion
carried.
Jim Larson, Finance Director appeared before -the Commission to ask to adopt the
Resolution for the Issuance of Refunding Improvements Bonds, Series 2021 A and 2021 B.
Following discussion, Commissioner Gjerdevig moved and Commissioner George
seconded to adopt the Resolution for the Issuance of Refunding Improvements Bonds,
Series 2021 A and 2021 B. No opposition. Motion carried.
Dustin Scott. City Engineer appeared before the Commission to ask for approval of the
Resolution Directing Assessments to be Levied • Sewer, Water, Storm and Street
Improvement District Numbers 132L 1322, 1323, 1325, 1329 • Street Improvement District
Numbers ~ 2245 • Storm Sewer Improvement District Number 4063. District 2250 was
taken as a separate item, vote. Following discussion, Commissioner Olson moved and
Commissioner Gjerdevig seconded to approve the Resolution Directing Assessments to
be Levied • Sewer, Water, Storm and Street Improvement District Numbers 1321, 1322,
1323, 1325, 1329 • Street Improvement District Numbers~, 2245 • Storm Sewer
Improvement District Number 4063. Commissioner George opposed. Motion carried.
District 2250 was opened as a separate item. Elton Tufte of 4200 Carmell Place, West
Fargo came forward to speak on the item. Following discussion, Commissioner Olson
moved and Commissioner Gjerdevig seconded to approve the Resolution Directing
Assessments to be Levied • Street Improvement District Numbers 2250. Commissioner
George opposed. Motion carried.
Commissioner George opened up the agenda item for discussion regarding the arterial
road assessments. Following discussion, Commissioner George moved and
Commissioner Gjerdevig seconded to direct staff to review the Special Assessment
policy. No opposition. Motion carried.
Commissioner George opened up the agenda item to discuss the Special Assessment
Committee review request. Commissioner George moved and Commissioner Gjerdevig
seconded to ask City staff to meet with Special Assessment Committee members to ask
for recommendations or changes and then bringing those back to the City
Commission. No opposition. Motion carried.
Commissioner Gjerdevig opened up the agenda item to discuss the annexation of
properties south of main avenue. Following discussion, Commissioner Gjerdevig moved
and Commissioner Olson seconded to direct staff to review the possibility of the
annexation of the fairgrounds, Bonanzaville, Campgrounds, and Cass County Offices.
No opposition. Motion carried.

Tina Fisk, City Administrator appeared before the Commission and provided the
following for the City Administrator Report:
A. Fargo, West Fargo and the County will meet on Legislative items
B. Update on Love Your Local
C. Introduction of Tim Solberg as the new Assistant City Administrator
In regards to non-agenda items Kevin Brennan and Brad Schmitz brought up an
agenda item for approval to move forward with their work by getting an early building
permit or not having a permit at all. Following discussion, Commissioner George moved
and Commissioner Gjerdevig seconded to approve the request of moving forward
without a permit. Commissioner Dardis and Commissioner Olson opposed. Motion failed
due to a tie.
Also in regards to non-agenda Bob Jensen from 4406 South River Estates Way came
forward to request for more information to be available to the public through the
website.
Commissioner Gjerdevig moved and Commissioner Olson seconded to adjourn the
meeting. No opposition. Meeting adjourned at 9:23 PM.
