Background. On the March 24, 2026, City Council meeting, following the
reading of the bill by title only, the Council tabled consideration of a motion.
The first reading and public hearing was held on March 10, 2026.
PROPOSED MOTION:
This bill is before the City Council for consideration. Should the Council
consider a motion, staff suggest the following:

AN ORDINANCE TO AMEND THE ZONING ORDINANCE OF THE CITY OF
OLIVETTE, BEING CHAPTER 400 ZONING REGULATIONS, AND CHAPTER 425
COMMUNITY DESIGN, BOTH CHAPTERS BEING PART OF TITLE IV LAND USE OF
THE OLIVETTE MUNICIPAL CODE, FOR PROPOSED STANDARDS GOVERNING
RESIDENTIAL ROOFTOP SOLAR PANELS
WHEREAS, the installation of residential rooftop solar panels requires the review and approval of
the Planning and Community Design Commission ("Commission"); and
WHEREAS, the City Council ("Council") has requested the Commission develop regulations to
streamline the review and approval of residential rooftop solar panels; and
WHEREAS, on January 15, 2026, the Commission reviewed and discussed the following text
amendments proposed by staff to authorize administrative approval of certain residential rooftop solar panel
installations:
1. Amend Chapter 425 Community Design-General ("Chapter 425") to permit tempered glass
associated with rooftop solar panels.
2. Amend Chapter 400 Zoning Regulations ("Chapter 400"), specifically Article XVI Accessory
Structures Section 400.1592 Permitted Accessory Structures in Residentially Zoned District, to add
a twelfth item subparagraph "B. Residential…." As follows:
to add a twelfth item in the list of rooftop solar panels.
3. Under rooftop solar panels, add the following conditions:
12. Rooftop Solar Panels.
a. Subject to the following:
• installed parallel to the existing roof plane.
• roof plane not exceeding an angle/slope of 45° (forty-five degrees).
• consist of comparable color to that of the existing rooftop covering.
• limits the potential of any direct glare to an adjacent property.
• grouped and centered within the roof plane in which being mounted.
WHEREAS, on January 15, 2026, the Commission acted on the draft text amendment and
approved a motion to recommend to the Council adoption as presented in the Memorandum from the
Department of Planning and Community Development dated January 15, 2026;
WHEREAS, in accordance with the procedures outlined under Article XX Changes and
Amendments, being part of Chapter 400 of Title IV Land Use of the Olivette Municipal Code, due and lawful
notice of a public hearing on the proposed amendment, to be held by the Council on March 10, 2026, at
7:00 PM in the City Council Chambers at the Olivette City Center, 1140 Dielman Road, Olivette, Missouri,
was published in the St. Louis Countian, a newspaper of general circulation in the City of Olivette, on
Monday, February 23, 2026; and
WHEREAS, a public hearing was duly and properly held by the Council at the time and place
provided for in the notice and all comments, statements, objections, and suggestions concerning the text
amendments to Chapter 425 and Chapter 400 were duly heard and considered by the Council; and
WHEREAS, the Council, after careful and due deliberation, has determined that the proposed text
amdendment is in the interest of the public health, safety, welfare, and morals of the City of Olivette.

Section One.
The term "Acceptable Material Finish", being part of Section 425.010 Definition of Chapter 425
Community Design-General of Title IV Land Use of the Olivette Municipal Code, is hereby amended to read
as follows:
ACCEPTABLE MATERIAL FINISH
An exterior finish for a single-family home that the Olivette City Council has determined may be
approved through administrative procedures. Acceptable material finishes include: standard brick or
stone veneer, hardboard siding, fiber cement, stucco, drivit or EIFS, horizontal aluminum siding, vertical
and horizontal vinyl siding, any hardwood based siding, excluding plywood and soft woods such as
cedar, and tempered glass associated with rooftop solar panels.
Section Two.
Under subparagraph "B. Residential…" of Section 400.1592 Permitted Accessory Structures in
Residentially Zoned Districts, being part of Chapter 400 Zoning Regulations of Title IV Land Use of the
Olivette Municipal Code, is hereby amended to include the following:
12. Rooftop Solar Panels.
a. Subject to the following:
• installed parallel to the existing roof plane.
• roof plane not exceeding an angle/slope of 45° (forty-five degrees).
• consist of comparable color to that of the existing rooftop covering.
• limits the potential of any direct glare to an adjacent property.

Section Three.
It is hereby declared to be the intention of the Council that each and every part, section and
subsection of this Ordinance shall be separated and severable from each and every other part, section and
subsection hereof and that the Council intends to adopt each said part, section and subsection separately
and independently of any other part, section and subsection. In the event that any part of this Ordinance
shall be determined to be or to have been unlawful or unconstitutional, the remaining parts, sections and
subsections shall be and remain in full force and effect.
Section Four.
This Ordinance shall be in full force and effect from and after its passage and approval as provided
by law.

Resolution 2026-265 - A Resolution in support of the Lights Out Heartland Campaign
Description:
The City of Olivette follows best lighting practices in its parks to reduce light pollution and
prevent light trespass on neighboring homes. In 2021, Stacy Park was certified as the first
Urban Night Sky Place location in the United States, and the fourth in the world, by Dark Sky
International (IDA). Five Oaks on Warson, the City’s community center, was designed with
interior lighting for optimal human health, and with exterior lighting that meets IDA guidelines for
limiting light pollution.
The Parks and Recreation Department annually partners with Dark Sky International and the St
Louis Chapter of the Audubon Society in providing educational materials and workshops for
residents and businesses on how to prevent bird strikes and how to design safe and effective
lighting for homes and offices.
An extension of these partnerships is to support migratory birds through wider education about
limiting exterior lighting during peak migration. Olivette sits directly on the Mississippi Flyway,
the largest bird migration coordinator in the US. Billions of birds migrate north in the spring and
south in the fall. The vast majority of birds fly at night, navigating by using the moon and stars.
As they pass over big cities, they often become disoriented by artificial lights and sky glow. An
estimated 600 million birds in the U.S. die each year from collisions with buildings. A study
published by Cornell Lab of Ornithology ranked the St Louis Metropolitan Area as the fifth most
dangerous city during spring migration and the sixth most dangerous city during fall migration.
Olivette joins several local agencies in supporting Lights Out Heartland including the City of
Clayton, Washington University in St Louis, Bellefontaine Cemetery, the Missouri Department of
Conservation, St Charles County Parks, the National Parks Service, and Gateway Arch National
Park, and many others.

RESOLUTION NO. 2026-265
A RESOLUTION IN SUPPORT OF THE LIGHTS OUT HEARTLAND CAMPAIGN
WHEREAS, Lights Out Heartland is a collaboration of organizations from the heartland area of the
United States of America, including Dark Sky International and the Audubon Society, partnering to
reduce light pollution during bird migration periods; and
WHEREAS, most songbirds and water birds migrate at night, navigating by using the stars and moon,
and often become disoriented by bright artificial light and sky glow, resulting in exhaustion or deadly
collisions with buildings and glass; and
WHEREAS, collisions with buildings are one of the top causes of mortality of birds in the United States,
with St. Louis ranking as the fifth most dangerous city during spring migration and the sixth most
dangerous city during fall migration; and
WHEREAS, the City of Olivette is located on the Mississippi Flyway, the most heavily used migration
corridor in North America, covering over 2,300 miles from Canada to the Gulf of Mexico, supporting
over 325 bird species, including 40% of the continent’s water birds, and 60% of migratory birds; and
WHEREAS, the City of Olivette is home to Stacy Park, the first Urban Night Sky Place in the United
States, and fourth in the world, certified by Dark Sky International; and
WHEREAS, Stacy Park and the City’s other four parks provide crucial resting and food sources for
migrating and resident birds; and
WHEREAS, The City of Olivette encourages Olivette businesses, organizations, and residents to turn off
exterior lighting during the high migration intensity months of May and September; and
WHEREAS, The City Council further commits to encouraging City-owned and/or managed buildings to
participate in the Lights Out Heartland campaign; and
WHEREAS, The City will continue to share educational information to the whole community through
brochures, facilities, website, and social media platforms; and
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
OLIVETTE, MISSOURI AS FOLLOWS:
The City Council supports the Lights out Heartland Campaign during the months of May and September
and urges all residents and businesses, where safe and practical, to participate in turning off exterior
lights.

Review. Upon review of the application and police investigation, the applicant
has received:
• A favorable recommendation from the Chief of Police; and
• Is found to be of good moral character and current on all taxes to the
City, the State, the County, or the municipality in which the applicant
resides.
Recommended Action:
Motion to authorize the City Clerk to issue a Liquor License for the remaining
2026 calendar year to "Stay In Your Lane Entertainment, LLC" doing business
as Olivette Lanes, addressed at 9520 Olive Boulevard.

Summary Description:
Per Chapter 600 Liquor Control, being part of Title VI Business and Occupation
of the Olivette Municipal Code, it is unlawful for any person to sell or expose
for sale intoxicating liquor in any quantity, either for consumption on the
premises where sold, or in the original package and not for consumption on
the premises where sold, except as provided under Chapter 600 Liquor Control.
Chapter 600 is the process of obtaining, regulating, and disciplining liquor
license holders.
The application. Applications for a license shall be filed with the City Clerk.
The application contains information sufficient to inform the City regarding the
qualifications of the applicant. Each application shall be signed by the
applicant. The signature of the applicant shall constitute an agreement that
the applicant assumes responsibility for compliance with the provisions of the
City ordinances and the laws of the State regulating the sale of intoxicating
liquor.

Police review. The Chief of Police then supervises an investigation of the
validity of the statements contained in each application for a license, including
a criminal background check for every individual and every officer as defined
herein. The chief's recommendation is then presented to the City Council at
the next regular or special meeting after issuance of the report.
Council action. Upon approval of the application by a majority of the Council,
the City Clerk then grants the applicant the requested license for a term to
expire effective through the end of the current calendar year (December 31,
2026).
Standards for approval. No person shall qualify for a license under this
Chapter if that person, or any officer:
1. Does not receive a favorable recommendation from the Chief of Police;
2. Is not of good moral character and current on all taxes for which he or
she is liable to the City, the State, the County, or the municipality in
which he or she resides;
3. Is not at least twenty-one (21) years of age;
4. Has had a liquor license revoked;
5. Has been convicted of violating the provisions of any law applicable to
the sale or manufacture of intoxicating liquor, provided that no person
shall be denied a license solely due to a single conviction for the unlawful
sale or supply to a minor when serving in the capacity as an employee
of a licensed establishment;
6. Employs a person whose liquor license has been revoked or who has
been convicted of violating the provisions of any law applicable to the
sale or manufacture of intoxicating liquor, provided that no license shall
be denied if the actionable violation(s) occurred more than three (3)
years prior to the date of the Council's license determination;
7. Has been convicted of violating the provisions of any law involving the
distribution, sale or possession of any controlled substance or dangerous
drug;
8. Makes a false statement of material fact, or by deliberate omission is
untruthful, in the application for a license; or
9. Does not otherwise comply with all laws and regulations related to liquor
control established by the State of Missouri, including but not limited to
Chapter 311, RSMo., and the City of Olivette, including but not limited
to this Chapter.

POLICE CLEARANCE -- A police clearance from Saint Louis City and Saint Louis County for the corporate managing
officer or individual.
STATE LIQUOR LICENSE -- The applicant shall include as part of the application a copy of the application packet for state
liquor license, or a copy of the state license, as applicable.
FELONY IDENTIFICATION -- identity of any anticipated employee convicted of a felony, and every licensed employer shall
report to the city clerk the identity of any employee convicted of a felony.
TAXPAYER CERTIFICATE -- A certificate from the Saint Louis County Collectors Office asserting that the applicant is a
taxpaying citizen of the State of Missouri in good standing.

INVESTIGATION AND STANDARDS OF APPROVAL
Section 600.070. Investigation required; board determination; renewals.
(a) The chief of police shall supervise an investigation of the validity of the statements contained in each application for a license under this chapter, including
a criminal background check for every individual and every officer as defined herein. Applications shall be made at least 31 days prior to the date that the
applicant desires to commence selling or dispensing intoxicating liquor. The police department is not required to conduct an investigation of any person who
has submitted an incomplete application packet.
(b) Except as provided in Section 600.070(c), an applicant shall submit a set of his or her fingerprints taken by the Olivette Police Department for transmission
to the Missouri State Highway Patrol (“MSHP”) in the form and manner required or allowed by the MSHP.
(c) In lieu of providing fingerprints for a background check initiated by the police department, the applicant may submit sealed, authenticated, and
contemporaneous background checks prepared by the MSHP at the applicant’s request. The chief of police shall determine whether the submitted
background checks are authentic and contemporaneous with the application.
Section 600.080. Standards for approval of license, generally.
(a) No person shall qualify for a license under this chapter if that person, or any partner, manager, officer, director or any individual owning ten per cent or more
of the stock or financial interest therein:
(1) Does not receive a favorable recommendation from the chief of police;
(2) Is not of good moral character and current on all taxes for which he or she is liable to the City, the state, the county, or the municipality in which he or
she resides;
(3) Is not at least 21 years of age;
(4) Has had a liquor license revoked;
(5) Has been convicted of violating the provisions of any law applicable to the sale or manufacture of intoxicating liquor, provided that no person shall be
denied a license solely due to a single conviction for the unlawful sale or supply to a minor when serving in the capacity as an employee of a licensed
establishment;
(6) Employs a person whose liquor license has been revoked or who has been convicted of violating the provisions of any law applicable to the sale or
manufacture of intoxicating liquor, provided that no license shall be denied if the actionable violation(s) occurred more than three years prior to the
date of the council’s license determination;
(7) Has been convicted of violating the provisions of any law involving the distribution, sale or possession of any controlled substance or dangerous drug;
(8) Makes a false statement of material fact, or by deliberate omission is untruthful, in the application for a license; or
(9) Does not otherwise comply with all laws and regulations related to liquor control established by the State of Missouri, including but not limited to
Chapter 311 RSMo., and the City of Olivette, including but not limited to this Chapter.

The Olivette City Council met on March 24, 2026 at 7:00 PM via videoconferencing, livestreaming
and in person at the Olivette City Center, 1140 Dielman Road, Olivette, MO 63132. Mayor Clark
called the meeting to order.
Item #1 – Roll Call
On roll call, the following persons were present: Mayor Sidney Clark, Council Member Mike
Solomonov, Council Member Kate Pichon-Hellmann, and Council Member Bryan Lewis.
Chairman Pro-tem Maxine Weil was absent with an excuse.
Also, in attendance were City Manager Jennifer Yackley, Director of Finance Darren Mann,
Director of Planning and Community Development Carlos Trejo, Director of Parks and Recreation
Beverly Tucker Knight, City Attorney Stephanie Karr, and Deputy City Clerk Jennifer Conrad

Item #3 – City Manager’s Report
City Manager Jennifer Yackley updated the Council on the following:

Item #4 – Staff Reports
Ms. Yackley reported highlights from Staff reports, including:
• Fire – Conducted training for fires in stairways and below grade.
• Parks and Recreation – Weed Warriors cleared weeds at Stacy Park. The open mic night
at Five Oaks was successful. Staff has been working on ballfield grading.
• Planning and Community Development – Distributed surveys to all licensed businesses.
Nominations for business/restaurant of the year have closed.
• Police – Polar Bear Plunge raised $1,020 for Special Olympics. The next event is the Torch
Run in May. National Prescription Drug Take Back Day is 4/25 from 10-2 at the City
Center.
• Public Works – Ameren is working on an underground electrical project on Price Road this
spring/summer.

Item #5 – Monthly Financial Report – February 2026
Director of Finance Darren Mann gave the eight-month financial report. Revenues are up overall.
We have a nice momentum from the use tax and have mostly caught up on property taxes.
Item #6 – City Council Liaison Reports
Council Member Solomonov stated that he had no report.
Council Member Pichon-Hellmann stated that she had no report.
Council Member Lewis stated that he had no report.
Mayor Clark stated that he had no report.
Item #7 – Hearing from Citizens
Alan Robbins, 47 Enfield Road, spoke regarding snow removal on sidewalks and stated that
neighbors should be advised that removal is required.
Stephanie Todd, 7 Heather Hill stated that she is concerned that she and others submitted
written comments to communications@olivettemo.com and they were not included in the
Communications portion of the agenda. Ms. Yackley stated that she would investigate whether
or not these were received and what happened.
Ms. Todd also stated that she was here at the previous meeting regarding concerns with the
color of the solar panels in Bill #3059. She also asked about glare and how it would be measured.
She asked that the glare and color requirements be removed from the Bill.
Sim Fremerman, SAF Construction & Remodel, stated that he and his business partners
purchased the Olivette Village condos and are remodeling them but are looking for guidance in
getting permits issued.
Erol Amon, 3 Dumbarton Dr., stated that he is also with the partnership working on the Olivette
Village condos and they would like to get working on them and get them remodeled to improve
the community.
Item #8 – Bill #3059 – An Ordinance To Amend the Zoning Ordinance of the City of
Olivette, Being Part of Chapter 400 Zoning Regulations, and Chapter 425 Community
Design, Both Chapters Being Part of Title IV Land Use of the Olivette Municipal Code,
for Proposed Standards Governing Residential Rooftop Solar Panels – Second Reading
Carlos Trejo, Director of Planning and Community Development, stated that he was available for
questions.
Council Member Solomonov stated that he would like time to review the written communications
that were not received before voting on the Bill.
A motion was made by Council Member Pichon-Hellmann to table Bill #3059 – An Ordinance To
Amend the Zoning Ordinance of the City of Olivette, Being Part of Chapter 400 Zoning
Regulations, and Chapter 425 Community Design, Both Chapters Being Part of Title IV Land Use
of the Olivette Municipal Code, for Proposed Standards Governing Residential Rooftop Solar
Panels to the April 14, 2026 meeting. The motion was seconded by Council Member Lewis.

Item #9 – Bill #3060 – An Ordinance To Amend the Zoning Ordinance of the City of

Olivette Municipal Code, for Proposed Standards to Govern Data Centers – Second
Reading
Mr. Trejo stated that he wanted to clarify that there are no pending applications for a data center
in Olivette.
A motion was made by Council Member Solomonov to approve Bill #3060 – An Ordinance To
Amend the Zoning Ordinance of the City of Olivette, Being Part of Chapter 400 Zoning
Regulations of Title IV Land Use of the Olivette Municipal Code, for Proposed Standards to Govern
Data Centers. The motion was seconded by Council Member Lewis.
