Good evening, Mayor and Council. My name is Kelsey Hall. I'm an Assistant Town Attorney with the Town of Parker. The address is... 20120 East Main Street, Parker, Colorado, 80138. I am here tonight to request that you continue the hearing to approve the resolution of a substantial compliance for the Crow's Nest property until such time as the petition can be properly evaluated to determine if it meets the statutory criteria under the Municipal Annexation Act. This act requires the City Council to take appropriate steps to determine if the petition filed is substantially in compliance with the act. This evaluation is critical because the town has already identified numerous errors in the original petition and is concerned that given the short timeline between when the original petition was withdrawn on December 5th and when it was resubmitted on the 18th, those errors have not been addressed. The town has standing to request this continuance under the Annexation Act because it is a municipality within one mile of the area proposed to be annexed. In fact, the property to be annexed lies right on our southern border. This continuance is necessary because the town, service providers, and your own constituents have not had sufficient time to review the petition to ensure it substantially complies with the statute or the opportunity to fully respond to the proposal, which time and opportunity will allow city council to ultimately make a fair and reasoned decision. First, although the updated annexation petition was submitted to the city on December 18th, the town only received informal notice through your city manager at 2.30 p.m. on January 7th. just hours before the deadline to provide written comment for tonight's meeting. Pursuant to your policy, members of the public may not submit written comments after 4.30 p.m. on the Wednesday before the meeting. Furthermore, this hearing was not even publicly posted until late on Friday the 9th, meaning that constituents who may be interested and who did not personally receive notice from the city staff only had a few short days to review the petition and are also deprived of the opportunity to provide written comment. It is also unclear if any of the impacted service providers received formal notice to ensure that they would have the opportunity to evaluate the petition and provide a response. One of the major statutory criteria at this stage is the establishment of 1-6 contiguity for each of the four annexation maps. This can only be evaluated by a professional surveyor, and the town has not had sufficient time to receive this analysis. Moreover, there is no evidence that city staff evaluated the claims in the petition, including that the 1-6 contiguity has been established. which is all the more reason to continue this hearing until that claim can be verified. It appears from our limited review of this new petition that there are other defects that may be fatal. Second, there is absolutely no reason to rush through the annexation process for this property. Given the potentially significant impacts to the town, the citizens of Castle Pines, and the service providers who would service the property, the City Council should ensure that this process is both transparent and thoughtful. In this regard, the Municipal Annexation Act provides that the City Council, without undue delay, shall then take appropriate steps to determine if the petition so filed substantially complies with the Act. I would submit the continuing consideration of the resolution to a future date, such as potentially eight weeks, maybe sometime in March, to allow your staff, your constituents, the town, and the impacted service providers the opportunity to review the petition, including its 13 pages of legal descriptions, and 20 pages of annexation maps is appropriate to determine if the petition substantially complies with the act. Continuance of this matter would also facilitate discussions with the town of Parker and service providers with the goal of concluding an intergovernmental agreement to address the undeveloped property located between our jurisdictions, including this Christmas property. Development of the Christmas property is not even part of the city's existing comprehensive plan and development of the property is not contemplated by any of its neighboring jurisdictions or service providers. In fact, there's no documentation anywhere suggesting that the property can even receive water, sewer, electricity, or school services, as the service providers have not been given an opportunity to comment. Your comprehensive plan provides certain land use goals that could be used to guide negotiations for an intergovernmental agreement, especially to develop this property. These goals include LU 8.1 through 8.5, review projected developments to mitigate negative impacts on existing services and infrastructure, Maintain a development pattern of contiguous and logical extension of community resources and infrastructure. Encourage urban development in areas of existing and planned capacity and services and infrastructure. Ensure new development pays its fair share. And consider the capacity of community services and facilities, environmental resources, education, and transportation to accommodate development when annexing new lands into the city. The town therefore requests that city council continue its consideration of the substantial compliance resolution until such time as the petition can be properly evaluated by the relevant stakeholders. In the spirit of cooperation, the town further requests that you direct your staff members to engage in good faith negotiations with the town to enter into a growth idea that will ensure development occurs responsibly in the undeveloped area between our two jurisdictions, including Crow's Nest. I live at 212 Durham Court, as I have the last 36 years. We are about to increase your risk to a mass casualty event by your vote on Ordinance 9602, included in the consent agenda tonight. I have some basics, a basis for my, to share my concerns. I earned my post certificate at the San Diego County Sheriff's Academy. For four years, I was the only volunteer arson investigator for Cal Fire with police officer status. And I'm a Vietnam veteran and carried an assault rifle and a sidearm during the entire deployment. With the strongest possible request Please remove 2602 from the consent agenda so an adequate discussion can be held. Your letter from staff states on October 14th, council directed staff to bring forth this ordinance on first reading. One of the new council members have not even had a chance to officially present their questions or positions. Ordinance 2602 allows for any firearm can be brought into the council meeting office. council meeting or office, including long guns, assault rifles, shotguns, and all types of handguns. You are about to increase the risk of a mass casualty event by taking away the probable cause for a law enforcement officer to make contact with an individual for just carrying an assault weapon or sidearm into a council meeting or office. When you're in the desk and in walks an individual with an assault rifle and sits in the front row, You have to answer these questions. Will you feel threatened, uneasy, and at personal risk? Will you recall you voted for what is unfolding? Remember, you will not be able to call the DC Sheriff to respond since a citizen attending a council meeting or entering a city office with an assault weapon or sidearm is not a violation due to this ordinance. I am very sorry I was not accurate in my earlier email to you. I apologize for that. pointing a weapon at a person is a class one misdemeanor in Colorado. And I apologize for that. Don't get 80 years old. It goes easier. As staff contacted our insurance carrier to see what coverage and fees are affected by unrestricted permitting of firearms at council meetings and within the offices. I support the second amendment. I really do. However, I do believe there are certain venues where any weapon is just not appropriate. The actions of this council do affect individuals. I fear the potential of one of those adversely affected might not use appropriate judgment, even more so in this politically charged environment. Good evening. Good evening, Mayor, members, council. Tonight, staff is recommending approval of a BSA with Sabelle's Civil Landscape for 2026 Street Maintenance Services. This contract covers all essential right-of-way work, such as pop-hole repair, sidewalk, stormwater maintenance, debris removal, emergency response, and anything else you can think of. So we received six competitive proposals. and conducted detailed evaluations as well as interviews. Sabelle stood out for their responsiveness, nationalism, experience, and did with Castle Boone's their attention to safe and clean works and owns and strong resident communication as well as high quality past performance as a subcontractor here really brought them to the top. So this contract is consistent with the city's 2026 maintenance budget and provides flexibility for both routine and unforeseen repairs staff recommends approval of this agreement ensure reliable and responsible service to our residents throughout the year thanks are there any questions all right council members just a reminder this is an opportunity for you to ask questions of staff and i'll please save your discussion and comments for once we have a machine on the table uh council member cole will start you okay council member salazar I do have a question. I am curious, does this include median maintenance? And does it include the median across by 25? It can include median maintenance. This contract is more specifically for on-call services. All right, moving on to our next item, which is resolution 26-05, resolution of the city council of the city of Castle Pines, Colorado, authorizing the city manager to execute a letter of authorization on behalf of the city as owner of track B, Castle Pines North filing number 27, being a part of the northeast quarter of section 32 and the northwest quarter of section 33, T6S. R67W of the 6th PM, City of Castle Pines, County of Douglas, State of Colorado to process a subdivision reclass. Our staff presentation will be given by Community Development Director, Dawn Ferguson. Thank you, member and members of council. This request is to authorize the city manager to execute a letter of authorization to allow the Castle Pines North Metro District to process a subdivision replat in order to subdivide a track that is currently owned by the city into two tracks. One track to be owned and maintained by Castle Pines North Metro District for the purposes of a water tank and the other to be owned and maintained by the city as open space. The draft subject. The subject tract is tract B of the Castle Pines North filing number 27 subdivision. The tract is 15.83 acres in size and is... It is located along the city's northern border adjacent to Douglas County. So next slide. Let's just talk a little bit about the background of how we came to own this tract. In March of 2023, the city council approved an intergovernmental agreement with the Castle Pines North Metro District to take ownership, operation, and maintenance responsibilities for the district's recreation properties, which are shown here in orange. Over the course of 2025, the city has been working with the district to transfer the deeds of their recreation properties from the district to the city. And within this batch of deed transfers, we became the owner of Tracked Bean. Next slide. So Castle Pines North Metro District is needing to now subdivide the track again in order to develop on a portion of the track a water tank that has been planned since the original creation of this subdivision filing. It is strategically located to support the regional water system for Castle Pines North Metro District. The additional water tank will provide redundancy in service, increase water for fire flow protection, and will be proximate to Highlands Ranch water infrastructure, which will enable a mutually beneficial backup system between Highlands Ranch and Castle Pines North Metro District. Next slide. So a little bit about the process. Once the subdivision, if the letter of authorization is granted, Castle Plains North Metro District will move forward with a replat, a subdivision replat, which is proposed to be completed in 2026. This replat will be... will be subject to approval by city council, typically as a consent item. Next, it would move to a site design process. This is anticipated also this year. The site design process would be subject to approval by the Planning Commission. And then lastly, construction is anticipated in the year 2029 or 2030. Next slide. Subdividing the tract will not negatively impact the open space available for public use. Instead, it will enable the development of an additional water tank site in a strategic location that will benefit all residents of the district and support the regional water system. Any specific site design concerns can be handled and addressed at the time of the site design process. And for these reasons, staff supports authorizing the city manager to execute a letter of authorization so that the Castle Pines North Metro District can process a subdivision replat application. And that concludes my presentation. Thank you. Ken, we'll go ahead and move on to clarifying questions. Council, please again save your discussion and comments for when we have a question on the table. Are there any additional clarifying questions for staff? Oh. I'm sorry, if I may. Nate is here from Castle Pines Metro District to answer any specific questions about the water tank. Yeah. Is this an above ground facility that will be visible? What will it do to the sight lines, et cetera? And what will the city's impact be on the design aesthetic features if it is? We don't entirely know yet. The initial approach, the reason the site is one conducive to a tank is primarily the elevation. So we gain a lot in just having water higher from what we call our hydraulic grade line. plan would be to move forward with the tank that is at least mostly buried. So we would do our level best to get it as deep in the ground as possible. That's easier for us for maintenance. It also makes it easier to obscure that view from the city or from any residence. There's a pretty significant amount of real estate between where that tank would likely ultimately sit, more toward the back of that parcel. So we'd have a lot of opportunity to do different berming, landscape mitigation, trees, vegetation. I think that there's a very high possibility of being able to completely obscure it from view. In terms of tank access, we have an existing access easement that allows the steator interconnect pipeline with high-lift ranch water. That comes off of Monarch, so there wouldn't be any access needs for vehicle traffic or anything off of Serena. there is an easement between two houses with two pre-existing water lines that are stubbed in there for two different zones. So we would connect to that. The biggest impact there was, you know, we'd generally be in that little open space once a year for about an hour to open and close those valves and move on. But it would be a relatively low impact visually. Thank you. Additional questions? Council Member Mulvey? I have a couple. So you stop me when you need to, like you always do. So this is in my district, and I'm fully cognizant that you haven't done design yet. My question's for staff. Why do we need this authorization? What is changing in the process? The deed for this property was conveyed to the city last year in May. So we now own this property. Therefore, we need to be a party to authorize, because we own Track B, authorize Castle Pines North Metro District to process the subdivision replat as the applicant. That was the question. So when you say to process it, it sounds like we're delegating the authority to make a decision, but what we're really doing is delegating the authority to be the applicant. That is correct. And we've assumed authority to be an applicant for other people. as a city, so it's similar to that? Yes, yes it is. Okay, additional questions. All right, go ahead Council Member Mulvey. Yeah, can we go back to the timing slide please? Yeah, so the way I'm looking at that is that the city, I know this is administrative, to delegate the authority for them to be the applicant. But what I'm seeing in the process is very little opportunity for residents to weigh in on what turns out to be a big area where we don't know where the thing's going to be. And so it abuts a very long area. I've already heard from residents about this. And in fact, there is a potentially interested member who has moved and is now not interested on the Metro District Board. And so it's interesting to me that we don't have the full information, and this process doesn't allow the residents to weigh in when the full information becomes available, because it's going to be on consent and go to the planning commission without a lot of process. And so my question is, if that's typically on consent, knowing that it's a big area, Can that be modified because we retain the ability to make a decision? Logistically, we can't be the applicants and the decision maker as a city. Well, yes, we can. Okay. We have done that before. Okay. Including Parkway Plaza. Oh, right. Yeah. Okay. So, I mean, the courts have acknowledged that in some cases, the city, the local governing body will also be an applicant. Okay. So that's okay. And what you're talking about in the first process is really just the subdivision replat, which is almost like an administrative step. And you're not talking about the tank or the aesthetics of the tank or the execution of the tank during that process. So that's really in the second step, correct? Correct. Which will be a site and living plan? Or a location and extent process. Which we still have currently in our existing land development. Yeah. And at that point, there will be public input. Yes. During planning commission. Okay. So my thought, though, is that because this area geographically, some members may not be familiar with it, because this area geographically involves houses that have a steep hill, they're going to want to know where the subdivision is because that will indicate where the tank might be. And we know that that's very technical. I'm not involved with it. I don't know. whole shebang but it's going to be a technical decision undoubtedly but it's going to visually impact so i see those first two processes as places where residents might want to weigh in and so my question is can we be assured that by delegating it we're not delegating any of our rights as a city to allow our residents to weigh in when and where appropriate and for us as the city to make decisions about whether or not it's going to impact the soil movement and the water table and things like that. So we're not delegating any of that. Correct. Okay. All right. It's a lot, I know, but I really feel like it's important to have this stuff head on so people are aware because, again, this is just – delegating the authority for them to be the applicant. So the purpose of this resolution is for Council to find the petition for Crow's Nest annexation in substantial compliance with the requirements of the Annexation Act of 1965. Annexation is the process of adding territory to the city. Substantial compliance is the first of a four step process. Council previously found a petition for Crow's Nest annexation to be in substantial compliance on November 3rd, 2025, and set its eligibility hearing date for December 9th, 2025. However, due to an error in the legal description of the Crowfoot Valley Road and a deficient notice by the Douglas County News Press, the eligibility hearing could not take place, and the hearing was vacated. On December 18th, a new petition for Crow's Nest annexation was submitted to the city. So the substantial compliance resolution confirms that the petition is in the correct form and contains all the necessary information to determine if it is eligible to be annexed. If substantial compliance is deemed to be met this evening, we will set an eligibility hearing date for February 24th, 2026, which will be the second step in the four step process. Next slide. Crow's Nest is approximately 795 acres in size, located east of the city. on the west and east sides of Crowfoot Valley Road and includes a section of Crowfoot Valley Road. It is adjacent to Parker on the north and east sides. It is assemblage of parcels consisting of nine property owners. Next slide. Next slide. Through this one. So SAP does find the petition is in substantial compliance with the Annexation Act of 1965 and recommends setting its eligibility hearing date for February 24th, 2026. And it's important to me that we isolate the decisions we're making. As noted, it's administrative. And this is a decision about substantial compliance of the petition. And there may be some small correction at some point, but that doesn't mean there isn't substantial compliance. And so I would urge my members that as much as we all want to be good neighbors, that they think about whether or not somebody's being a good neighbor to us. by coming in and commenting on things that are irrelevant to our decision-making process here today and conflating the matter. It's disturbing. It's unprecedented. So while I welcome public comment at any time, I would urge my colleagues not to base their decision on anything other than the criteria that we've been presented with. Thank you. She's with me here today as I wear her ornament of her beliefs and symbol of her beliefs. And I just want to thank those of you who have expressed condolences and grace as I go through this process. It's meant a lot to me. I haven't failed to do my committee assignments with Dr. Cogg and the sub-regional 8470 that go with it, but reporting from it has been a little bit less than stellar and I've been absent. So again, thank you for your grace. Thank you for understanding. As the funeral is a week from now, I'll be back to normal business. Council Member Cole? I had an opportunity Friday to participate in the Denver Leadership Academy's Urban Planning session uh fascinating how do you the issues you get involved with and things you don't think about uh i do really appreciate your opportunity to attend that and it was quite a learning experience for him i would not say i appreciate that the majority of council has met with the applicants and asked questions and we're being very thorough with this process to make sure we're going in with eyes wide open and making sure that it's going to be a benefit in the long run. And I appreciate the developers being open to answering our questions and to meeting with us at any time. So we are doing our due diligence. Just a personal thing. I actually took my daughter on a discovery flight that's attending the airport. We hear about it a lot from customer view banks. And it was kind of fun to experience it for myself for a change. It's a great experience. You should take your kids on it. It's expensive, but it's a great experience for them. They actually get to fly a commuter. And then the only other thing to talk about is the Cherry Creek Basin Water Quality Authority Board. I'm actually at the point now where I can say it. Not a lot to report coming out of that. We're doing a lot of administrative work there. But we're going to have some big projects that we're probably going to be talking about in the next couple months. So I have a feeling I'll be reporting back a bit more then. Council Member Weiner. I have nothing official to report, but I do want to just say just a big thank you to the staff who have taken so much time to try and get me up to speed, make me feel comfortable with the onboarding. And the 70-plus communities that are on that coalition are really excited and passionate about it and trying any opportunity that they're in D.C. to put the word forward about what's happening and if there's any roadblocks, trying to talk to those Congress members to see if they can kind of alleviate any concerns that they have about the bill. But we are definitely moving forward and we're making progress. And hopefully we will see something, a new zip code for Castle Pines and the other coalition members before the end of first quarter.
