The Public Hearing of the City Council of Trenton, Michigan was called to order by
Mayor Rzeppa at 6:52 p.m. on the above date in the Council chambers.
Present on roll call by City Clerk Debra Devitt: Councilpersons Timber Baun
Crooks, Richard Benedetti, Scott Cabauatan, Emily Hornbeck, Nelson Perugi, and Mayor
Steven Rzeppa.
Absent: Councilwoman Dora Rodriguez.
Moved by Councilwoman Baun-Crooks, seconded by Councilman Cabauatan, to
excuse the absence of Councilwoman Rodriguez.
Carried unanimously.
There being a quorum present, the Council was declared in session.
Other Officers Present: Dean Creech, City Administrator; Joanie Barnett, City
Assessor; Michael McCullough, City Treasurer; Kevin Sargent, DPS Director; Paul Haley,
Emergency Management Coordinator; Elisabeth Sobota-Perry, HR Director; Donna Jensen,
Library Director; Tim Beaker, Parks and Recreation Director; and Mike Hawkins, Police
Chief.
Mayor Rzeppa read aloud the Notice of Public Hearing, Vacation of Property, Part of
Truax Street.
Mayor Rzeppa asked for comments from the public.
There was no comment from the public.
MOTION TO ADJOURN by Councilman Cabauatan, seconded by Councilwoman
Baun-Crooks, at 6:54 p.m.

After the Pledge of Allegiance to the Flag, a moment of silence was held for former
City of Trenton Deputy Police Chief Terry Rodriguez. The Regular Meeting of the City
Council of Trenton, Michigan, was called to order by Mayor Rzeppa, at 7:01 p.m. on the
above date in the Council chambers.

WHEREAS, The City council of the City of Trenton deems it to be in the public
interest to vacate the following described street, to-wit:
PART OF TRUAX STREET AS SHOWN IN ASSESSOR'S TRENTON PLAT NO.1
SECTION 18, TOWN 4 SOUTH, RANGE 11 EAST, CITY OF TRENTON, WAYNE
COUNTY, MICHIGAN, RECORDED IN LIBER 66, PAGE 28 OF PLATS, WAYNE
COUNTY RECORDS.
BEING MORE PARTICULARLY DESCRIBED AS: ALL THAT PART OF TRUAX
STREET (82.50 FEET WIDE) BEING BOUND ON THE WEST BY THE
EASTERLY LINE OF RIVERSIDE DRIVE (82.50 FEET WIDE) EXTENDED,

WHWEREAS, a public hearing on the vacation of the aforesaid street was held on
February 2, 2026.
NOW, THEREFORE, BE IT HEREBY RESOLVED that the City Council of the City
of Trenton does hereby vacate, subject to the following condition precedents, the following
described street, to-wit:
PART OF TRUAX STREET AS SHOWN IN ASSESSOR'S TRENTON PLAT NO.1
SECTION 18, TOWN 4 SOUTH, RANGE 11 EAST, CITY OF TRENTON, WAYNE
COUNTY, MICHIGAN, RECORDED IN LIBER 66, PAGE 28 OF PLATS, WAYNE
COUNTY RECORDS.
BEING MORE PARTICULARLY DESCRIBED AS: ALL THAT PART OF TRUAX
STREET (82.50 FEET WIDE) BEING BOUND ON THE WEST BY THE
EASTERLY LINE OF RIVERSIDE DRIVE (82.50 FEET WIDE) EXTENDED,
BOUND ON THE EAST BY THE U.S. HARBOR LINE, BOUND ON THE NORTH
BY LOT 102, AND BOUND ON THE SOUTH BY LOT 103. CONTAINING 1.056
ACRES.
This vacation is conditional only and shall not become effective, and the City Clerk
is not authorized to record, publish, or otherwise implement this vacation, unless and until
each condition precedent identified in this Resolution has been satisfied (or formally waived
in writing by the City Council, if applicable) and the City Council's conditions have been
confirmed as satisfied by the City Attorney.
BE IT FURTHER RESOLVED that as an express condition precedent to, and
prerequisite for the effectiveness of, the street vacation approved by this Resolution, the
City of Trenton shall retain an easement for public utilities purposes and surface drainage
for a minim um width of thirty (30) feet centered on the existing public storm sewer (the
"Easement"), and the Easement shall be executed in recordable form and recorded with the
Wayne County Register of Deeds contemporaneously with the vacation becoming effective.
BE IT FURTHER RESOLVED that, as an additional express condition precedent to,
and prerequisite for the effectiveness of, the street vacation approved by this Resolution,
the City Attorney shall confirm in writing that the City of Trenton has received, in
recordable form and with clear title, the real property (or property interests) to be conveyed
to the City by NABA Management as identified in the agreement reached between NABA
and the City in connection with litigation pending in Wayne County, Michigan (the "NABA
Agreement").
BE IT FURTHER RESOLVED that, without limiting the foregoing, the City
Attorney's written confirmation shall include confirmation that: (i) all required conveyance
documents have been fully executed and delivered to the City, (ii) any required recordings
have been completed (or are ready for immediate recording), and (iii) the City has received
satisfactory evidence of marketable title, including a title commitment or policy (or
equivalent evidence acceptable to the City Attorney) showing that the property is conveyed
free and clear of liens, encumbrances, and other title objections, except as expressly
approved in writing by the City Council.
BE IT FURTHER RESOLVED upon confirmation by the City Attorney that a
certified copy of this Resolution be forwarded by the City Clerk to the Wayne County
Register of Deeds for recording, and a copy be also forwarded to the State Treasurer.

authorize Fishbeck to prepare the project plan and apply for the Fiscal Year 2027 Drinking
Water State Revolving Fund, funding for lead service line replacements, in the amount of
$26,000.00, with funding from Water Fund/Contractual Services Account #592·563-818.000.
