A House Study Committee recently passed on to the legislative body a recommendation that a Constitutional
amendment be placed on the Fall ballot directing the State Legislature to place limits on the largest revenue
source, ad valorem taxes, for Counties and Cities across the State of North Carolina. The request includes no
details regarding what those limits ultimately include or entail.
b. Approve Construction Contract for EB-5864 Knoll Road Pedestrian Improvements
Approve Construction Contract for EB-5864 Knoll Road Pedestrian Improvements following formal bid and
Concurrence in Award from NCDOT. Staff ask Council to approve award of the Construction Contract and
authorize the Town Engineer to execute the agreement.
5. COUNCIL UPDATES AND DISCUSSION
a. FY27 Draft Budget Update
Staff will provide updated figures following changes made during and since the Council Retreat earlier in the
month.
b. Project Updates
Staff will discuss the current status of projects to include FY26 Paving, the North Pressure Zone Water Tank,
Reservoir Dam bids, and Town Hall progress.
c. Planning Department Update
Planning staff will briefly update the Town Council on agenda items coming in May and progress on Phase 3
Comprehensive Plan implementation projects.

Opposing State House Committee Recommendations For A Constitutional Amendment or
Other Efforts to Universally Infringe on Local Authority Regarding Property Taxes
WHEREAS, The Town of Southern Pines is committed to providing essential public services and maintaining
a high quality of life for its residents, including police and fire protection, parks and recreation, street
maintenance, a library, and community amenities; and
WHEREAS, the Town Council has historically carefully considered the impacts of revaluation and adjusted
tax rates appropriately, resulting in a decline from 40 cents per $100 in FY24 all the way down to a tax rate of
29 cents per $100 in FY26; and
WHEREAS, unlike local governments in many of the other states referenced during recent House Committee
meetings, North Carolina Counties and Municipalities rely on property tax revenue as their most stable and
locally controlled funding source to provide essential services to residents and businesses; and
WHEREAS, unlike enterprise services funded through user fees, general government services rely heavily on
property tax revenue, making them especially vulnerable to any universal restrictions on that revenue source;
and
WHEREAS, legislation imposing ill-conceived limits on the growth of local property tax revenues, including
levy limits and requirements for voter approval to exceed those limits, would significantly restrict the ability of
local governments to maintain service levels, respond to growth, and plan responsibly for the future; and
WHEREAS, public safety services, to include fire protection and law enforcement, represent critical and
resource-intensive responsibilities of local government, requiring consistent and predictable funding to ensure
adequate staffing, training, and response capabilities; and
WHEREAS, imposing rigid caps on property tax revenue would force local governments into a reactive
financial posture, resulting in delayed investments, reduced service levels, and increased long-term costs to
residents; and
WHEREAS, requiring voter referenda to exceed arbitrary revenue limits would introduce uncertainty and
delay into the funding of essential services that must be maintained without interruption; and
WHEREAS, a vast number of Counties and Municipalities across North Carolina maintain excellent bond
ratings and the ability to borrow funds at reasonable rates in order to serve their populations as a result of the
current parameters surrounding the setting of local ad valorem tax rates providing confidence to investors and
lenders; and
WHEREAS, Under the current system North Carolina municipalities have played a significant role in
providing a quality of life for residents and businesses that has resulted in the State being consistently rated #1
or near #1 for creation, expansion, or relocation of business in the United States; and
WHEREAS, Local elected officials are directly accountable to their residents and are best positioned to make
informed decisions regarding taxation and service levels based on community needs that can vary wildly from
one location to another, making a centralized “one size fits all” approach inevitably flawed; and
WHEREAS, a limitation of $1.50 cents per $100 valuation is already statutorily in place with no locality actually
levying that amount; and
WHEREAS, the existence of a long-standing statutory limit is indicative of the legislature’s authority to set
rules without an unnecessary Constitutional Amendment; and
WHEREAS, multiple references have appeared in the media regarding Legislator’s statements that “by no
means all” local governments are perceived as “guilty” of whatever transgressions various proposals suggest to
be addressing; and

WHEREAS, such statements would suggest that individual scenarios perceived as problematic may better be
worked through locally and case-by-case rather than threatening a system that has proved successful in
promoting the growth and general recognition of the State as a whole;
NOW, THEREFORE, BE IT RESOLVED by the Southern Pines Town Council that:
1. The Town of Southern Pines strongly opposes any state legislation that limits local property tax
authority, including levy limits, revenue caps, or mandatory voter referenda to exceed such limits;
2. The Town affirms that flexibility in property taxation is essential to funding core public services,
including law enforcement and community amenities that directly impact residents’ daily lives;
3. The Town urges the North Carolina General Assembly to reject any legislation that would undermine
the ability of municipalities to fund essential services;
4. The Town further urges state leaders to recognize that limiting property tax revenues will not reduce
the need for services, but will reduce the ability to provide them effectively;
5. The Town calls for the preservation of local control and accountability, allowing locally elected officials
to make responsible fiscal decisions based on the needs of their communities;
6. The Town Clerk is directed to transmit this resolution to:
o Members of the North Carolina General Assembly representing Moore County.
o Leadership of the North Carolina General Assembly,
o The North Carolina Association of County Commissioners, and
o The North Carolina League of Municipalities.
ADOPTED this 28th day of April 2026.

Thank you for the documentation on the Town of Southern Pines’ proposal to award a
construction contract for the above-referenced project. This is to advise that the
Department of Transportation concurs in the award of Project EB-5864 to the low bidder
as received and noted in the attached concurrence memo. The low bidder is:
Fred Smith Company $3,425,315.00
MAXIMUM REIMBURSEMENT POSSIBLE: $3,032,000 (per the Agreement)
The low bidder met the Disadvantaged Business Goal (DBE) of 0.0%. The final goal for
DBE participation on this construction contract is 0.0%.
When the Town schedules a pre-construction meeting, please ensure that the Division
Contact and the Federal Highway Administration are notified and invited.
Failure to have appropriate staff at the meeting will delay the project and may impact
the funding available.
Once the construction contract is fully executed, please furnish two (2) copies of the

In the Southern Pines Public Works Building at 9:00 am on March 20, 2026, the
bidding for the above referenced project was closed. Two bids were received for the
EB-5864 Knoll Road Pedestrian Improvement Project. Kimley-Horn has reviewed
these bids and prepared the certified bid tabulation.
Based on the information provided in the certified bid tabulation, with a combined base
bid amount of$3,425,315.00, it appears thatFred Smith Company is the qualified low
bidder and is in good standing for this project. This information is not a guarantee of
their performance on this project. However, we have found no definitive objectionable
information that would suggest that Fred Smith Company should not be awarded this
project. As such, we recommend award of the EB-5864 Knoll Road Pedestrian
Improvement Project to Fred Smith Company.

Re: FY27 Draft Budget
Attached: Data Updates
Based on information received via our Retreat earlier this month in addition to new data
through Thursday the 23rd, the following changes have been made to the Draft FY27
Budget. A current balance sheet is included in your packet following this Memo.
1. The “final” Moore County appraised value document arrived, demonstrating the
figures presented at Retreat.
2. Per Retreat discussion, a penny of ad valorem tax receipts were removed, now using
a rate of 29 cents and decreasing previous draft revenues $485,387
3. Per Retreat discussion, Waste Removal Fees structure was returned to its current
formula resulting in a Revenue decrease of $296,322.
4. A transfer to Storm Water that appeared in the previous draft budget has been
removed as it was partially “double accounted” for within 2026 GF expenditures.
5. Merit/Market Adjustment figures have been recalculated and individual
departmental line-items adjusted accordingly.
6. A SBITA onboarding originally (mis)accounted for in 2027 was moved to 2026,
resulting in the “saving” of the 25% reserve.
7. We dropped a couple of small planned software modules from the FY27 Draft
8. Per Retreat, the Campbell House Tee Box refresh and upgrade was removed.
9. Patrol (2k), Investigations (2k), PD Communications (2k), and Finance (1k) all
reduced their training and travel budgets.
10. January Sales taxes above budget are now accounted for in addition to a small
increase in 2027 estimates as a result of the three-year averaging approach.
11. We reduced both 2026 estimated ABC receipts and 2027 projections by $40,000
each after having received a third consecutive quarter of ABC receipts that have
regressed to pre-COVID amounts.
12. We added $9,000 to current year expenses toward some scanning and the
implementation of a document management system (Laserfiche)

Re: Current Project Updates
With a number of large initiatives in various stages of implementation, I simply wanted to
provide some status updates:
1. Knoll Road: Hopefully by the time we are discussing this Memo on Tuesday you will
have already approved the award of selection for construction of the multi-use path.
We do not as yet have a start date from the Contractor.
2. Paving: Contracts are in place and I have included in your packet the planned
schedule (subject to weather, materials, equipment, and labor cooperating, of
course.)
3. North Pressure Zone Water Tank: Engineer Michel is reviewing the bids with the
engineering consultant and apparent low bidder. The bids came in above estimates,
but we have the reserves to cover the project. I would anticipate a likely project
award and any necessary budget amendments for the May Business Meeting.
4. Reservoir Dam: Bids for this project came in extremely high, which appears to be a
trend for Dam work across the State. Bids are still under review and staff is working
on finding a path forward for this work. At least initially we may be as much as
$800,000 short in the CPF. It is a project that we might be able to delay, however
there is no reason to believe it gets any less expensive in the future (and likely just
the opposite.)
5. Downtown Park: Project is substantially complete. New sod is being allowed to
establish prior to opening for full use.
6. Whitehall Carriage House: Site work began this week on the drive and area around
the facility. This is expected to be a three week project leading up to the paving of
the drive.
7. Town Hall: The front lobby counter and glass is awaiting install, but otherwise the
first floor is nearly complete with furniture having been delivered and set-up this
week. Second floor furniture has now begun while work continues on the downstairs
Meeting Chambers A small contingent of employees will relocate to the building
next week as we begin to phase moves leading up to a public opening. Our first
Council Meeting in the building may be July, though we await delivery of the entrance
door for the Chambers. Generator bids are due mid-May.
